Lease Transfer Procedures

The following refers to The Winkler Organization, Inc. (hereinafter called “Landlord”), the Tenant leaving the unit (hereinafter called “Vacating Tenant”), the Tenants staying in the unit (hereinafter called “Remaining Tenants”), the individual attempting to assume the Vacating Tenant’s lease (hereinafter called “New Tenant”), and the Residential Rental Contract (hereinafter called “Lease”).

  1. NEW TENANT. New Tenant must understand, and agree to assume, all obligations as a tenant under the terms of Lease for the unit, which includes any and all damages and/or rental fees, or balances due and payable to the Landlord.

  2. NEW TENANT. Units that are currently occupied will not be inspected, cleaned, painted or otherwise repaired. In other words, the New Tenant is accepting the apartment and bedroom he/she will occupy “AS IS”, and any charges found as a result of the Move Out Inspection at the end of the lease will be equally charged to the New Tenant.

  3. NEW TENANT. New Tenant assuming the Vacating Tenant’s Lease is required to submit an Application Fee and Application for approval, a signed and notarized Lease Guarantee, as well as the appropriate Security Deposit and Administrative fee prior to signing the Lease and the Amendment to Residential Rental Contract. First months’ rent must be paid on the day the Lease begins, prior to receiving keys, parking permit (where applicable), before moving into the unit.

  4. ALL TENANTS. Unless the Remaining Tenants notify the Landlord’s office in writing regarding damages to the common area(s) that should be charged against the Vacating Tenant, the Vacating Tenant will not be charged and his/her full security deposit will be refunded within 30 days of his/her Lease expiration. Landlord must be notified of these damages prior to Lease Transfer. The new tenant will be given a Move‐In Inspection Sheet to record any damages and it must be returned to the office within 5 days. The vacating tenant will be charged for any damages found by the new tenant.

  5. VACATING TENANT(S). The Vacating Tenant is responsible for overseeing this process and will not be notified by the Landlord of the status.

  6. VACATING TENANT. The Vacating Tenant must pay a $250 Lease Transfer Fee prior to the New Tenant signing the Lease. This Fee must be paid with a personal check or money order; the fee cannot be taken out of Vacating Tenant’s Security Deposit.

  7. VACATING TENANT. If the Vacating Tenant owes any rental balance, it must be paid prior to the New Tenant signing the Lease.

  8. VACATING TENANT. The Landlord is not responsible to schedule, coordinate, or in any way oversee or be held responsible for the progress, nor notification of progress of the Lease transfer. Allowing a Lease to be transferred is a benefit to the Vacating Tenant, who is therefore fully responsible to see that this entire process is followed through and completed in its entirety. The Lease transfer will not be acknowledged or binding until ALL steps are completed. Any steps not completed will cause the Lease transfer to be null and void.
